High Court Enforcement Officer vs County Court Bailiff is one of the most important comparisons a business faces after obtaining a County Court Judgment (CCJ).

NPD, over the years, have instructed both the County Court Bailiff and High Court Enforcement Officers when recovering commercial debts on our clients’ behalf. This article reflects our direct, practical experience of both enforcement routes in England & Wales.

Enforcing a County Court Judgment (CCJ)

Once you have obtained your County Court Judgment, the next decision is whether — and how — to enforce it.

If the debtor does not pay, one option is to enforce by taking control of the debtor’s goods.

In practical terms, that means either:

  • Issuing a Warrant of Control through the County Court; or
  • Transferring the judgment to the High Court for enforcement under a Writ of Control.

The route available depends on the value of the judgment:

  • Judgments under £600 can only be enforced by the County Court Bailiff.
  • Judgments of £600 or more can be transferred to the High Court and enforced by a High Court Enforcement Officer.

County Court Bailiff (Warrant of Control)

A County Court Bailiff is a salaried officer of the Court.

They are paid whether recovery is successful or not.

Our Experience

  • Commercial pressure is modest
  • Overall success rates are poor

This reflects the structure of a salaried public enforcement system operating within a busy court environment.

Costs & Risk

  • The County Court fee for issuing a Warrant of Control is £94, and this is added to the debt.
  • If the Warrant is returned unsatisfied, there are no further Bailiff enforcement fees payable.

At that stage, alternative enforcement strategies may need to be considered.


High Court Enforcement Officer (Writ of Control)

If the judgment is £600 or more, it can be transferred to the High Court and enforced by a High Court Enforcement Officer (HCEO).

Historically referred to as Sheriffs or Sheriff’s Officers, the modern legal term is High Court Enforcement Officer.

Unlike County Court Bailiffs, HCEOs operate on a commission-based structure.

Our Experience

When recovering commercial debts on our clients’ behalf, we have found High Court Enforcement Officers to be:

  • Significantly faster in attendance
  • More proactive in approach
  • Commercially driven
  • Materially more effective in achieving recovery

Over many years, High Court enforcement has recovered some very difficult and complicated commercial debts on our clients’ behalf. It is rare, in our experience, for a Writ to be returned unsatisfied.

Costs & Risk

  • The High Court transfer-up fee is £71, and this is added to the judgment debt.
  • If the Writ is returned unsatisfied, a Compliance Stage fee of £75 plus VAT is payable.

Enforcement procedures are governed by guidance issued by HM Courts & Tribunals Service.

If further enforcement is required following an unsuccessful Writ, the matter may need to be transferred back to the County Court.


High Court Enforcement Officer vs County Court Bailiff – NPD Opinion

Both routes are lawful enforcement mechanisms.

However, based purely on our lived experience recovering commercial debts on our clients’ behalf, this is NPD’s opinion:

County Court Bailiff
Lower upfront exposure if unsuccessful — but slow process and poor success rates.

High Court Enforcement Officer
Faster, commercially driven, and in our experience considerably more effective.

A County Court Judgment is only paper until it is enforced.
The enforcement route you choose can materially affect the outcome.
